What Is Georgia’s Lemon Law?
Georgia’s Lemon Law (Georgia Code § 10-1-781 et seq.) protects consumers who purchase new vehicles with defects that substantially impair the use, value, or safety of the car. If your car qualifies, you may be entitled to a replacement vehicle, a refund, and reimbursement for towing, rental, or incidental costs. The law requires the manufacturer to fix the problem after a reasonable number of repair attempts. If they can’t, they must make it right—or face legal action.
Does My Vehicle Qualify Under Georgia Lemon Law?
To bring a valid Lemon Law claim in Georgia, your car must be new (or a demonstrator model), purchased or leased in Georgia, and show signs of a defect during the Lemon Law rights period (typically the first 24 months or 24,000 miles). The issue must substantially impair the vehicle’s use, value, or safety. You must allow the manufacturer a reasonable number of repair attempts—usually three for the same issue—or have the vehicle out of service for 30+ days. You may also need to send a final notice letter requesting one last repair attempt before pursuing legal remedies.
Common Defects That Trigger Lemon Claims
Transmission failure, engine stalling, overheating, electrical malfunctions, backup camera failure, warning light issues, airbag system problems, brake defects, or HVAC failures—any of these recurring problems may qualify your car as a lemon.
What You Can Recover Under Georgia Lemon Law
If successful, you may recover a full refund of the vehicle’s purchase price (including taxes, registration, and dealer fees), a comparable replacement vehicle, and reimbursement for towing and rental costs. In some cases, attorney’s fees and court costs are also recoverable. The goal is to make you whole after the financial and emotional drain of owning a defective vehicle.
